1. Agreement and scope
These Terms and Conditions apply when you access or use mylesequipment.com, contact us through the website, or rely on information published here. “Myles Equipment,” “we,” “us” and “our” mean Myles Equipment Ltd. “You” means the website visitor, prospective customer, customer, hirer or person acting for an organisation.
The website provides general information and a way to request a quotation. It does not itself create a rental contract, reserve equipment or guarantee availability. Any equipment hire, operated service, delivery or related work is governed by the quotation, rental agreement, work order or other written contract accepted by both parties. If that signed document conflicts with these website terms, the signed document controls for that transaction.
Nothing in these terms excludes a right or remedy that cannot lawfully be excluded under applicable Turks and Caicos Islands law, including applicable consumer-protection requirements.
2. Website access and acceptable use
You may use this website for lawful personal or business purposes connected with learning about our services or contacting us. You must not interfere with the website’s operation or security, attempt unauthorised access, introduce malicious code, scrape the site in a way that materially burdens it, impersonate another person, submit false information, or use the site to violate any law or third-party right.
We may change, suspend or withdraw any part of the website without notice. We aim to keep information accurate and available, but do not promise uninterrupted access, freedom from errors or that every description, photograph, dimension or capability is complete. Equipment shown may differ from equipment available for a particular hire.
Intellectual property
The website’s design, text, photographs, video, graphics, logos and other materials are owned by or licensed to Myles Equipment and are protected by applicable intellectual-property laws. You may view and print reasonable extracts for evaluating our services. You may not republish, sell, alter, systematically copy or commercially exploit site materials without written permission.

Links to third-party websites are provided for convenience. We do not control their content, security, availability or privacy practices. Your dealings with a third party are governed by that party’s terms.
3. Enquiries, quotations and rental contracts
You must provide accurate and complete information about the requested equipment, project, site, island, access, dates, intended work, materials, ground conditions and any hazards. A website acknowledgement only confirms receipt; it is not acceptance of an order.
Quotations are subject to equipment and personnel availability, site assessment where required, transport feasibility, credit or identity checks where applicable, and the quotation’s stated validity period. Prices, deposits, taxes, delivery, collection, operator, fuel, cleaning, mobilisation, waiting-time, overtime and damage charges will be governed by the applicable quotation or rental agreement. Unless expressly stated, website descriptions are not fixed-price offers.
A rental begins and ends at the times stated in the applicable agreement. Extensions require our prior approval and may incur additional charges. Cancellation, postponement and refund terms are those stated in the accepted quotation or rental agreement. We may refuse or cancel work where performance would be unsafe, unlawful, impracticable, outside the agreed scope, or prevented by non-payment or a material breach.
4. Customer and site responsibilities
Unless a signed agreement states otherwise, the customer is responsible for providing safe, lawful and suitable access; identifying underground, overhead, coastal and site hazards; obtaining required permissions; supplying accurate lifting, load, terrain and ground information; keeping unauthorised persons clear; and following reasonable safety and operating directions.
Equipment may be used only for the agreed purpose, within manufacturer limits and applicable law, by suitably trained and authorised persons. You must not misuse, overload, modify, sub-hire, relocate, export, abandon or permit unauthorised operation of equipment. Safety devices, labels and tracking or identification equipment must not be disabled or removed.
You must inspect equipment as reasonably required, stop use if a defect or unsafe condition is suspected, secure equipment against theft and weather, and notify us promptly of accidents, damage, loss, seizure, breakdown or third-party claims. You must not arrange repairs without our authorisation except where immediate action is reasonably necessary to prevent injury or further damage.
Responsibility for fuel, daily checks, cleaning, security, loss, damage and return condition will be stated in the rental agreement. Where we provide an operator, the customer remains responsible for site information, access, coordination and hazards under its control, while our operator retains authority to stop work that appears unsafe.
5. Availability, delays and force majeure
Equipment availability and delivery times are estimates until confirmed. Weather, sea conditions, inter-island transport, port operations, mechanical issues, road access, emergencies, labour disruption, government action and events outside reasonable control may delay or prevent performance. We will take reasonable steps to communicate and mitigate material disruption but are not responsible for delay caused by circumstances beyond our reasonable control, subject to rights that applicable law does not allow us to exclude.
6. Liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, loss of profit, revenue, opportunity, production, contract or anticipated savings arising from website use or a rental. Any transaction-specific allocation of risk, insurance obligations, indemnities and liability cap will be stated in the applicable rental agreement.
Nothing excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence where it cannot lawfully be limited, or any other liability that applicable law prohibits us from excluding. You remain responsible for losses resulting from inaccurate site information, unsafe conditions under your control, unauthorised operation or breach of the applicable agreement.
7. Indemnity
To the extent permitted by law and subject to the applicable rental agreement, you agree to indemnify Myles Equipment against third-party claims and reasonable losses arising from your unlawful use of the website, your breach of these terms, or misuse of equipment by you or persons for whom you are responsible. This does not apply to the extent a loss was caused by our negligence or breach.
8. Privacy and communications
Our Privacy Policy explains how we handle personal information. Our Cookie Policy explains the site’s current use of cookies and similar technologies. By submitting an enquiry, you authorise us to respond using the contact details provided. We will not treat a marketing communication as consent where consent is legally required.
9. Changes and severability
We may update these terms to reflect changes in the website, our practices or applicable law. The effective date identifies the current version. Changes apply from publication and do not retroactively alter an already signed rental agreement unless that agreement permits it. If a provision is held invalid or unenforceable, the remaining provisions continue in effect.
10. Governing law and disputes
These terms are governed by the laws of the Turks and Caicos Islands. The courts of the Turks and Caicos Islands have jurisdiction, subject to any mandatory consumer right or agreed dispute-resolution provision that applies. Before commencing formal proceedings, the parties should attempt in good faith to resolve a dispute through direct written communication.
